Purchasing from Balanced Body & Mind Co Chelsea Ferwerda sets forth this agreement and the terms and conditions of purchases of all products/services.

By placing your order with Chelsea Ferwerda by 'accept/submit/pay now', or by using these services, you agree to be bound by this Agreement. If you do not agree with these terms, please leave the website/program/form and discontinue this service immediately.

'We/us/our/I' means Coaching with Chelsea Ferwerda.
'You/your' means you as the user of this service.



INDEMNITY:
You agree to full indemnity and to defend harmless Chelsea Ferwerda, and all affiliates, officers, managers, employees from any and all claims, liability damages, losses, harms, costs and expenses including legal fees and expenses incurred by you in any claims arising from all products/services. For any breach of this Agreement, Chelsea Ferwerda is not held liable by any third party.



INTELLECTUAL PROPERTY:
All materials and coaching provided to you as part of all products/services, and Contracts may not be duplicated, sold, re-used, modified, broadcast, transmit or re-post in any way without written consent from Chelsea Ferwerda.
All trademarks, logos and service marks respective of Chelsea Ferwerda of Balanced Body & Mind Co provided as part of this Agreement are protected by Australian and Intellectual Property Laws.
If any provision under this agreement is held to be invalid, the remainder of this agreement will remain in full force and in full effect.



WAIVER:
By purchasing any products/services from Balanced Body & Mind Co, you are of the understanding that your ability or inability to use these services are at your SOLE risk. You accept, agree, and understand that you are FULLY responsible for your own progress and results. Chelsea Ferwerda will offer no guarantees verbally or in writing regarding your finance earnings/loss, business/personal performances, or results of ANY kind.

YOU are responsible for your own actions and results in your personal life and business, which are dependent on, but not limited to: your skill, knowledge, ability, discernment, dedication and financial situation. Chelsea Ferwerda does not and will never offer professional legal, medical, psychological or financial advice as outlined in these terms and conditions.
Under NO circumstances is either party (You, and Chelsea Ferwerda) responsible for any incidental, consequential, indirect, special exemplary or other damages under this Agreement. Chelsea Ferwerda's liability to you for any cause, regardless of the form of action, will be limited to the amount paid, if any, by you to Chelsea Ferwerda for the services Agreed to after purchasing.

Any party (You, and Chelsea Ferwerda) that shall breach these terms, your products/services will be terminated immediately with no payments expected to be refunded partially or in full, with Chelsea Ferwerda accepting no damages as agreed to in above terms.



PAYMENT:
All payments are to be made via Stripe Payment Link/Portal. If you choose to not participate in agreed products/services, you are doing so by your choice and understand that full refunds and/or partial refunds will NOT be given or returned.



PAYMENT POLICY:
Payment is required before beginning the all services either in full or via agreed payment plan as outlined in the above paragraph. By agreeing to these terms, you agree to not cancel or issue chargeback for any transaction with your bank or credit card company. Chelsea Ferwerda is NOT responsible for any overdraft fees, limit charges or fees charged by your bank or credit card company.
Failure to make payment as outlined above will result in immediate termination of these services to agreed upon.
